A local landlord with a history of sexual harassment allegations will serve nearly two years in jail, a judge ruled Friday.
Camilo Delfinado, who cornered a tenant in a bathroom and exposed his penis to her, pleaded guilty in November to a single count of assault and three misdemeanor counts of sexual battery, reduced from felony attempted rape.
Delfinado was charged three times with sexual battery between 2002 and 2004. Each time, the case was dismissed. He was charged with the same crime again in 2010, and it was again dismissed.
In May, a tenant used her phone to take a video of Delfinado as he backed her into a corner with his genitals showing. He was arrested three days after a local TV station aired a portion of the video.
Charges were then filed and he has been in jail since.
In August, Delfinado was found guilty of misdemeanor sexual battery and assault. He appealed to the Circuit Court and was subsequently indicted on the felony attempted rape charge.
That was dropped when he pleaded guilty to the misdemeanors.
Davida Davis, a supervising deputy clerk of the Circuit Court, said Delfinado was sentenced to four years with 28 months suspended.
In addition to the 20 months in jail, Delfinado was ordered by Circuit Judge John R. Doyle III to three years’ good behavior upon release, indeterminate supervised probation with sex offender treatment, and to not have contact with current or prospective female tenants, said Amanda Howie, spokeswoman for the Commonwealth Attorney’s Office. He is also not to have contact with the victims.
Doyle declined work release for Delfinado but authorized home electronic monitoring, Howie said.
